Earwise is operated by Earwise LLC, a California limited liability company. These terms are the agreement between you and Earwise LLC for use of the Earwise website, apps, and browser extension (together, "Earwise" or "the service").
By using Earwise you accept these terms. If you don't accept them, please don't use the service.
You need to be at least 13 to hold an Earwise account. If you are under 18, you may use Earwise only with the involvement of a parent or guardian who accepts these terms on your behalf.
Earwise includes a children's mode with age-appropriate material. It is designed to be set up and controlled by an adult from their own account. Children using that mode are using their parent's or guardian's account, and that adult is responsible for its use. We do not knowingly create accounts for children under 13. If you believe a child under 13 has created an account, tell us at hello@earwise.app and we will remove it.
You are responsible for what happens under your account, including keeping your sign-in details to yourself. Tell us promptly if you think someone else has access to it.
You may close your account at any time. When you do, we delete the content stored under it as described in the privacy policy.
Anything you bring into Earwise yourself: text you paste, articles you save by URL, and files you upload such as PDFs and Word documents — including any images, figures, charts, or diagrams inside them.
We claim no ownership of your content. You give us only the permission we need to run the service for you: to store it, convert it to speech, and deliver it back to you on the devices where you are signed in. That permission exists for that purpose and no other. It ends when you delete the content or close your account.
Your content is private to your account. We do not publish it, sell it, show it to other users, or use it to train models. Text and images you upload are stored under your account only, and our access controls are what enforce that — not merely our promise.
To avoid re-synthesising the same sentence over and over, generated audio is stored in a shared cache addressed by a one-way hash of the sentence text itself. No account identifier is attached to it, and there is no record of which sentences belong to which user. Another user can receive a cached audio file only by independently submitting a sentence with identical characters — that is, only if they already have that exact text themselves. The cache holds no ordering information and cannot be listed or browsed, so a document cannot be reconstructed from it. Your uploaded documents, and the images inside them, are never shared this way.
By bringing content into Earwise you confirm that you own it or otherwise have the right to use it this way, and that having us store it and read it aloud to you is a personal use you are entitled to make. Earwise is not a way to obtain material you do not already have, and not a way to distribute it. Do not upload content you have no right to, and do not use Earwise to share content with people who have no right to it.
Deleting a saved item removes its text and its stored images from your account, and it stops being retrievable by you almost immediately. Backups are purged on a rolling basis within 30 days. Shared cached audio is content-addressed and is not deleted individually, because it is not linked to your account in the first place and could equally have been generated by anybody who submitted the same sentence.
If you believe something stored on Earwise infringes your copyright, write to our designated agent. Full instructions, including what a notice must contain and how to send a counter-notice, are on our copyright page.
Repeat infringers. We terminate the accounts of users who repeatedly infringe copyright.
Earwise also offers a library we assemble ourselves from public-domain works, government publications, and openly licensed sources. Those works remain subject to whatever licence applies to them. The library is provided as part of the service and may change — items can be added, corrected, or removed.
Please don't:
Earwise has a free tier with monthly limits, and a paid subscription with higher limits. The current price, billing period, and limits are shown before you pay. We take card payments through Stripe; if you subscribe through an app store, that store handles billing under its own terms.
Earwise is actively developed. Features may be added, changed, or withdrawn. If we withdraw something you're paying for and can't offer a reasonable equivalent, tell us and we'll deal with it fairly.
We may remove content or suspend an account when we receive a valid legal notice, when we are required to by law, or when content or behaviour plainly violates these terms. Where we can, we will tell you why.
You may stop using Earwise, and delete your account, at any time.
Earwise is provided "as is". We don't warrant that it will be uninterrupted, error-free, or that the audio will be accurate for every text. Speech synthesis mispronounces things; extraction from PDFs and web pages is imperfect. Don't rely on Earwise as your only source for anything that matters — medical, legal, financial, or safety-critical.
Earwise is not an accessibility-compliance product and we make no representation that using it satisfies any legal accessibility obligation you may have.
To the fullest extent the law allows, Earwise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost opportunity, arising out of your use of the service.
Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty U.S. dollars.
Some jurisdictions don't allow certain limitations, in which case the limitations above apply only as far as that jurisdiction permits.
You agree to indemnify Earwise LLC against claims arising from content you upload that you did not have the right to upload, or from your use of the service in breach of these terms.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Sacramento County, California, and you and we each consent to their jurisdiction.
We may update these terms. When we make a material change, we'll update the date at the top and tell account holders by email or in the app before it takes effect. Continuing to use Earwise after that means you accept the updated terms.
