How Earwise handles copyrighted material

Earwise has two kinds of content, and they work differently.

Our library is material we have chosen deliberately: public-domain works, government publications, and openly licensed sources. If you believe we have misjudged the rights status of anything in the library, please tell us — that is a mistake we want to correct quickly, and you do not need a formal notice to raise it.

Your own uploads are different. When you paste text, save a page, or upload a file, we store it so we can read it back to you on your devices. It is private to your account: it is not published, not shared with other users, and not used to train models. Storing it is something we do at your direction, for your personal use.

Reporting an infringement

If you own a copyright, or are authorised to act for the owner, and you believe material stored on Earwise infringes it, send a notice to our designated agent:

What your notice needs to include

So we can act on it — and so it counts as valid notice under 17 U.S.C. §512(c)(3) — please include all of the following:

1. Your name, address, telephone number, and email address.
2. Identification of the copyrighted work you say has been infringed. If you are reporting several works, a representative list is fine.
3. Identification of the material you say is infringing, with enough detail for us to locate it.
4. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
5. A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.
6. Your signature, physical or electronic.

Please send notices to the agent above rather than to general support, so they reach the right place without delay.

A note before you send one

Misrepresenting that material is infringing carries liability for damages under §512(f). Because uploads on Earwise are private to the account that made them and are never distributed to anyone else, some situations that look like infringement from the outside are ordinary personal use. We mention this not to discourage a genuine notice, but because it saves everyone time.

What we do when we receive a valid notice

• We remove or disable access to the material, usually promptly after we have read the notice.
• We tell the affected user what was removed and why, and pass on your notice where we are permitted to.
• We keep a record of the notice, so we can recognise repeat problems.

Counter-notice

If your content was removed and you believe that was a mistake — for example because you hold the rights, or the use is permitted by law — you may send a counter-notice to the same agent. It should include:

1. Your name, address, telephone number, and email address.
2. Identification of the material that was removed and where it appeared before removal.
3. A statement under penalty of perjury that you believe in good faith the material was removed as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the U.S. District Court for the judicial district where you live (or, if you are outside the United States, the Eastern District of California, where Earwise LLC is located), and that you will accept service of process from the person who sent the original notice.
5. Your signature, physical or electronic.

We may restore the material after a waiting period set by law unless the original complainant tells us they have filed a court action.

Repeat infringers

We terminate the accounts of users who repeatedly infringe copyright. We decide what counts as repeated on the facts — the number of valid notices, whether they were contested, and whether the same material reappears after removal — and we apply that policy in practice rather than only stating it here.
